This document sets out the University policy and procedure for using disclaimers in University print and electronic publications.
The University takes strenuous steps to ensure that information provided via its print and electronic publications is current and accurate and, in the case of confidential information, is directed to the intended recipient. However, University staff should use an appropriate disclaimer in providing such information in order to:
mitigate liability arising from the provision of incorrect or outdated information;
reserve the right to make changes without notice;
alert readers to the necessity that they independently check the accuracy of information;
assert copyright ownership; and
expressly refute responsibility for the accuracy or content of information in particular circumstances.
This policy and procedure applies to all publications and communications activities by all elements of the University of Melbourne.

It is recommended that a disclaimer be included in e-mails sent by University staff:
To minimise the University's liability for the transmission of viruses and defects by placing the onus on recipients to check attachments and by warning recipients that we do not warrant that an email is free from defects;
To ensure that the University asserts any copyright or confidentiality rights it has in respect of material contained in an email;
To ensure that an unintended recipient of an email cannot argue that the University has waived any rights it may otherwise have had in respect of copyright, confidential or personal information; and
To protect the privacy of information contained in an email
'This e-mail and any attachments may contain personal information or information that is otherwise confidential or the subject of copyright. Any use, disclosure or copying of any part of it is prohibited. The University does not warrant that this email or any attachments are free from viruses or defects. Please check any attachments for viruses and defects before opening them. If this e-mail is received in error please delete it and notify us by return e-mail.'
A personal email not related to University business, must clearly establish that the views expressed in the email are not necessarily those of the University.
'The University does not necessarily share or endorse the views expressed in this email.'
Each page of the University's website should contain a link to
(i) the University's disclaimer: (http://www.unimelb.edu.au/disclaimer/index.html)
(ii) information on our privacy policy. (http://www.unimelb.edu.au/disclaimer/privacy.html)
To fully alert visitors to our website that while the University uses reasonable endeavours to ensure information uploaded is accurate at the time it is posted, the University does not warrant that it is accurate or current;
To reserve the right to change information without notice such as course details and minimise allegations of misleading information and misrepresentation;
To distance the University from external websites which are linked for convenience. This is necessary to ensure that the University is not seen as endorsing a website, product, company or viewpoint of an external organisation and also to remove responsibility for the accuracy and currency of information appearing on external websites;
To prohibit framing (where an external organisation displays a University web page on its website but retains its own surroundings, rather than providing an external link - thus giving the impression of some sort of affiliation with the University); and
To assert copyright ownership.
The following is the standard University disclaimer to be linked to every web page. Accuracy of information
'The University of Melbourne has used its best endeavours to ensure that material contained on this web site was correct at the time the relevant page was created or modified, however:
1. The University gives no warranty and accepts no responsibility for the accuracy or the completeness of the material;
2. Users are advised to confirm the accuracy and currency of the information provided with the relevant faculty or department of the University before acting upon or in consideration of the information.
3. The University reserves the right to make changes at any time without notice in its absolute discretion. .
The University will not accept any liability for any loss or damage which may be incurred by any person acting in reliance upon the information contained in this web site.'
External Links
